A Department of Justice attorney admitted that “lost” emails from Lois Lerner’s hard drive do exist on an emergency backup system, Judicial Watch President Tom Fitton said today.

"The Department of Justice attorney told the Judicial Watch attorney on Friday that it turns out the federal government backs up all computer records in case something terrible happens in Washington and there is a catastrophe. So the government can continue operating. They say it would be too hard to go get Lois Lerner's e-mails from that back-up system.

"Everything we've been hearing about scratched hard drives, missing e-mails of Lois Lerner, other IRS officials, other officials in the Obama administration, it's all been a pack of malarkey. They could get these records but they don't want to and they haven't told anyone about it, frankly, until we were able to get it out of them on Friday. There's no such thing as Lois Lerner's missing e-mails. It's all been a big lie. They've been lying to the courts, to the American people and to Congress."

Judicial Watch has filed a lawsuit under the Freedom of Information Act (FOIA) for all “missing” records from the same time period at the IRS.

(Washington, DC) – Judicial Watch announced the following developments in the IRS’ missing emails investigation. Judicial Watch President Tom Fitton stated:

Department of Justice attorneys for the Internal Revenue Service told Judicial Watch on Friday that Lois Lerner’s emails, indeed all government computer records, are backed up by the federal government in case of a government-wide catastrophe. The Obama administration attorneys said that this back-up system would be too onerous to search. The DOJ attorneys also acknowledged that the Treasury Inspector General for Tax Administration (TIGTA) is investigating this back-up system.

We obviously disagree that disclosing the emails as required would be onerous, and plan to raise this new development with Judge Sullivan.

This is a jaw-dropping revelation. The Obama administration had been lying to the American people about Lois Lerner’s missing emails. There are no “missing” Lois Lerner emails – nor missing emails of any of the other top IRS or other government officials whose emails seem to be disappearing at increasingly alarming rate. All the focus on missing hard drives has been a diversion.

The Obama administration has known all along where the email records could be – but dishonestly withheld this information. You can bet we are going to ask the court for immediate assistance in cutting through this massive obstruction of justice.

Are our Congressional investigators naïve, or are they part of a vast conspiracy to hide a simple truth from the American people about the decisions made & not made that fateful night?

You see ladies & gentlemen, in order for a “stand down” to be given, an order has to be given to ready those soldiers to “stand down” from. Here lies the crux of administration’s failures the night of Sept. 11, 2012.

No “stand down” order was ever issued, because the request for an order to engage in a foreign land was refused to begin with!

To initiate offensive military operations in a foreign country, law requires a Presidential order commonly referred to a Cross Border Authority or CBA.

In the absence of cross border authority being granted directly by the President, no military operation could be initiated, including the commitment of troops to secure or rescue personnel from Special Mission Benghazi.

It is well known that a distress signal went out from the CIA Annex before it was attacked.

Congressional investigators should be asking the following three questions:


Was Cross Border Authority requested by our operation commanders assigned to North Africa?
Which particular Officer requested it?
Was Cross Border Authority granted?

The answers to these three questions lead responsibility directly to the Commanders in Africa, and ultimately to the President, who is the only one tasked with issuing cross border authority.

A bipartisan Senate Intelligence Committee has found that the State Department could have likely prevented the death of four Americans in Benghazi if they would not have ignored the intelligence reports and pleas for assistance from our diplomatic mission. The findings are that increased security was needed.

The report, worked on for months and released Wednesday by a bipartisan Senate intelligence committee, also says 15 people in Libya who have tried to help the FBI investigate the murders have been killed. Does it matter now Mrs. Clinton?

Obama thinks he can defend Americans by causing them to be "armed to the teeth".

What did the term "armed to the teeth" originate?

The term originated in Port Royal Jamaica in the 1600s when pirates were constantly looking for ships to loot and their guns were very primitive. As a result, pirates could shoot only once before a long reloading process. Consequently, they needed to carry a gun in each hand, and also perhaps in each pocket. For extra power, they would also hold a knife between their teeth. So to be 'armed to the teeth' means to carry the maximum number of weapons possible.
