Continuing Resolution Threatens Preparations for 2010 Census

October 16, 2007 – U.S. Census Bureau Director Louis Kincannon testified before Congress on how the Census Bureau's funding levels under a continuing resolution through Nov. 16 is threatening critical preparations for the 2010 Census. Speaking for more than an hour before the House Oversight and Government Reform Subcommittee, Kincannon discussed the impact of the continuing resolution budget that funds most government activities at previous fiscal year levels. The Census Bureau is uniquely affected because its budget almost doubles this year as it ramps up for its 2008 Census Dress Rehearsal and other key 2010 Census operations and programs.

He discussed:

* The impact of operating under a continuing resolution at funding levels which are about half of what is needed to continue preparations for the 2010 Census.
* The importance of testing new hand-held computers and data capture operations, a top priority for the reengineered census. The new system will enhance efficiency and accuracy, reduce paper and save money, but the Census Bureau cannot use the new devices without conducting a full systems test.
* Due to the delay in funding, there will be a reduced-scope Dress Rehearsal. Smaller important operations which have been successful in pervious censuses, such as group quarter’s enumeration, will also not be tested prior to the 2010 Census.
* If funding is delayed beyond Nov. 16, it will call into question the ability to test the hand-held systems at all.

The 2010 Census is reengineered, reduced dress rehearsal, and possibly no test of the new hand held systems at all. Emmanuel sucked at the teat of probably the most corrupt political machine in the history of our nation, the Daley machine in Chicago. Now he may be running the 2010 census, which will have profound political implications for at least a decade. Obama wants to substitute a sampling for the enumeration. He wants to skew the numbers and redraw the congressional districts to get his thugs reelected!


Apparently the new president forgot that the Commerce Secretary oversees the census when he appointed NH conservative Republican Senator Judd Gregg to that post. To remedy that oversight it looks like he’ll be transferring the task to Chief of Staff Rahm Emmanuel.

As a matter of impact, the census has tremendous political significance. Political parties are always eager to have a hand in redrawing districts so that they can maximize their own party’s clout while minimizing the opposition, often through gerrymandering.

The census also determines the composition of the Electoral College, which chooses the president. If one party were to control the census, it could arguably try to perpetuate its hold on political power.

The results of the census are also enormously important in another way — the allocation of federal funds. Theoretically, a political party could disproportionately steer federal funding to areas dominated by its own members through a skewing of census numbers.

Here’s an argument that it’s unconstitutional for the president to take over the Census from the secretary of commerce. It goes like this: Article I, Section 2 of the Constitution provides for an “actual enumeration” and a statute passed by Congress provides that the duties under this clause are to be performed by the secretary of commerce. Article I (as Joseph Biden didn’t know in debate) is about the legislative, not the executive branch. Hence, it is argued, the president can’t substitute a sampling for the enumeration required to be done by the secretary.

Of course he could simply fire the Commerce Secretary and appoint one that will do his bidding. Assuming this plan is put into action it will be interesting to see the legal challenges to this power grab unfold.

Anyone, other than the most besotted Kool-Aid drinker of Obama speak, should now be able to see the specter of the Chicago Way running full gallop inside the White House. One cannot emerge from the cesspool of the Daley machine and not be contaminated. The stench precedes this latest power grab plan. Obama is nothing more than a smooth talking actor raised and groomed in the most corrupt political machine in this country. It seems that the President is circumventing the legally authorized cabinet departments, ‘en masse’.

The Bureau is continued as an agency within, and under the
jurisdiction of, the Department of Commerce.

SUBCHAPTER II–OFFICERS AND EMPLOYEES
Sec. 21. Director of the Census; duties
The Bureau shall be headed by a Director of the Census, appointed by
the President, by and with the advice and consent of the Senate. The
Director shall perform such duties as may be imposed upon him by law,
regulations, or orders of the Secretary.

In addition the bureau can use employees from other departments. The question is if the President’s Chief of Staff is involved does he work for Commerce (permitted) or does the census now report to the White House (not permitted). It’s the Commerce Secretary and Congress’ call.

FACT: The Census has always been performed under the oversight of the Commerce Department.

FACT: The Obama Administration is attempting to move the Census oversight to the White House.
