Exceptions in Stimulus Bill Allow Sale of Your Health Records

It could become easier to sell and exchange the health information of Americans under the economic stimulus package that President Barack Obama’s signed Tuesday Jul 13, 2009.

The $787 billion American Recovery and Reinvestment Act that passed Congress last week allocates $19 billion to establish centrally linked health data infrastructure to contain the health information of “each American” by 2014 and to set up the new office of the “National Coordinator for Health Information Technology.”

Though the legislation says there is a “prohibition on sale of electronic health records or protected health information,” there are five pages of exceptions to the prohibition that include research, treatment of an individual, or a decision by the Secretary of Health and Human Services to waive the prohibition.

One exception listed in the legislation is if, “The purpose of the exchange is for public health activities.” Another exception is apparently to ensure the data – if sold – are not for commercial reasons, saying, “The purpose of the exchange is for research and the price charged reflects costs of preparation and transmittal of the data for such purpose.”

Another exception is rather broad saying, “The purpose of the exchange is otherwise determined by the secretary in regulations to be similarly necessary and appropriate” in accordance with the other exceptions.

Further, one of the exceptions seemingly states the government can obtain an individual’s health information for the purpose of protecting an individual’s privacy. It reads: “The purpose of the exchange is for treatment of the individual, subject to any regulation that the secretary may promulgate to prevent protected health information from inappropriate access, use or disclosure.”

The legislation also says that the prohibition will be reviewed after 18 months. The review will further explore whether the government “may further restrict the exception described in paragraph (2)(A) to require that the price charged for the purpose described in such paragraph reflects the cost of preparation and transmittal of the data for such purpose, if the secretary finds that such further restriction will not impede such research or public health activities.”

Some of these exceptions are already in the Health Insurance Portability and Accountability Act (HIPAA), a law with privacy provisions.

But the exceptions on exchanging or selling information could be more problematic to privacy if health records are digital, said Sue Blevins, president of the Institute for Health Freedom, a group that advocates health privacy issues.

“Digital records without consent is a recipe for invasion of privacy,” Blevins told CNSNews.com Monday. “Consent was gutted with HIPAA, but it is really hard to get out paper records. When they are made electronic, you can share data with a click of a mouse.”

Those who could be able to sell the information would be health care providers, insurance companies and other entities that collect the data.

A statement by the Democratic majority on the Senate Finance Committee says the information will not be used to influence treatment and that “Federal law makes your medical records--whether they’re on paper or in a computer--confidential to you and your health provider.”

'Invisible Gorilla' Test Shows How Little We Notice

A dumbfounding study roughly a decade ago that many now find hard to believe revealed that if people are asked to focus on a video of other people passing basketballs, about half of watchers missed a person in a gorilla suit walking in and out of the scene thumping its chest.

Now research delving further into this effect shows that people who know that such a surprising event is likely to occur are no better at noticing other unforeseen events - and may even be worse at noticing them - than others who aren't expecting the unexpected.

The so-called "invisible gorilla" test had volunteers watching a video where two groups of people - some dressed in white, some in black - are passing basketballs around. The volunteers were asked to count the passes among players dressed in white while ignoring the passes of those in black.

These confounding findings from cognitive psychologists Daniel Simons and Christopher Chabris detailed in a 1999 study revealed how people can focus so hard on something that they become blind to the unexpected, even when staring right at it. When one develops "inattentional blindness," as this effect is called, it becomes easy to miss details when one is not looking out for them.

"Although people do still try to rationalize why they missed the gorilla, it's hard to explain such a failure of awareness without confronting the possibility that we are aware of far less of our world than we think," Simons told LiveScience.

Gorilla infamy

Of course, these results are utterly counterintuitive, with 90 percent of people now predicting that they would notice the gorilla in the video. The problem is that this video has become so famous that many people know to look for a gorilla when asked to count basketball passes.

In new research, Simons decided to use the infamy of the invisible gorilla to his advantage, creating a similar video that asked for the same results from the audience.

"I thought it would be fun to see if I could monkey with people's intuitions again using almost the same task," Simons said.

Expecting the unexpected

Of the 41 volunteers Simon tested who had never seen or heard about the old video, a little less than half missed the gorilla in the new video, much like what happened in the old experiments. The 23 volunteers he tested who knew about the original gorilla video all spotted the fake ape in the new experiment.

However, knowing about the gorilla beforehand did not improve their chances of detecting other unexpected events. Only 17 percent of those who were familiar with the old video noticed one or both of the other unexpected events in the new video. In comparison, 29 percent of those who knew nothing of the old video spotted one of the other unexpected events in the new video.

"A lot of people seem to take the message of our original gorilla study to be that people don't pay enough attention to what is happening around them, and that by paying more attention and 'expecting the unexpected,' we will be able to notice anything important," he added. "The new experiment shows that even when people know that they are doing a task in which an unexpected thing might happen, that doesn't suddenly help them notice other unexpected things."

Once people find the first thing they're looking for, "they often don't notice other things," Simons said. "Our intuitions about what we will and won't notice are often mistaken."

Simons detailed his new findings online July 12 in the journal i-Perception.

Tea Party members have used "racial epithets," have verbally abused black members of Congress and threatened them, and protestors have engaged in "explicitly racist behavior" and "displayed signs and posters intended to degrade people of color generally and President Barack Obama specifically," according to the proposed resolution.

"We're deeply concerned about elements that are trying to move the country back, trying to reverse progress that we've made," NAACP spokeswoman Leila McDowell told ABC News. "We are asking that the law-abiding members of the Tea Party repudiate those racist elements, that they recognize the historic and present racist elements that are within the Tea Party movement."

The National Association for the Advancement of Colored People, in coordination with 170 other groups, including labor unions, is planning a protest march in Washington, D.C., Oct. 10 as the next step in building momentum against the Tea Party.

SUMMARY OF WHAT IS HAPPENING

The estimated super high pressure release of oil from under the earth's crust is between 80,000 to 100,000 barrels per day. The flow of oil and toxic gases is bringing up with it... rocks and sand which causes the flow to create a sandblasting effect on the remaining well head device currently somewhat restricting the flow, as well as the drilled hole itself.

As the well head becomes worn it enlarges the passageway allowing an ever-increasing flow. Even if some device could be placed onto the existing wellhead, it would not be able to shut off the flow, because what remains of the existing wellhead would not be able to contain the pressure.

The well head piping is originally about 2 inches thick. It is now likely to be less than 1 inch thick, and thinning by each passing moment. The oil has now reached the Gulf Stream and is entering the Oceanic current which is at least four times stronger than the current in the Gulf, which will carry it throughout the world within 18 months..

The oil along with the gasses, including benzene and many other toxins, is deleting the oxygen in the water. This is killing all life in the ocean. Along with the oil along the shores, there will be many dead fish, etc. that will have to be gathered and disposed of.

SUMMARY OF EXPECTATIONS

At some point the drilled hole in the earth will enlarge itself beneath the wellhead to weaken the area the wellhead rests upon. The intense pressure will then push the wellhead off the hole allowing a direct unrestricted flow of oil, etc.. The hole will continue to increase in size allowing more and more oil to rise into the Gulf. After several billion barrels of oil have been released, the pressure within the massive cavity five miles beneath the ocean floor will begin to normalize.

This will allow the water, under the intense pressure at 1 mile deep, to be forced into the hole and the cavity where the oil was. The temperature at that depth is near 400 degrees, possibly more. The water will be vaporized and turned into steam, creating an enormous amount of force, lifting the Gulf floor. It is difficult to know how much water will go down to the core and therefore, its not possible to fully calculate the rise of the floor.

The tsunami wave this will create will be anywhere from 20 to 80 feet high, possibly more. Then the floor will fall into the now vacant chamber. This is how nature will seal the hole. Depending on the height of the tsunami, the ocean debris, oil, and existing structures that will be washed away on shore and inland, will leave the area from 50 to 200 miles inland devoid of life. Even if the debris is cleaned up, the contaminants that will be in the ground and water supply will prohibit re-population of these areas for an unknown number of years. SEC. 430. ESTABLISHING A READY RESERVE CORPS.

(1) IN GENERAL.­ There shall be in the Service a commissioned Regular Corps and a Ready Reserve Corps for service in time of national emergency.

(2) REQUIREMENT.­ All commissioned officers shall be citizens of the United States and shall be appointed without regard to the civil-service laws and compensated without regard to the Classification Act of 1923, as amended.

(3) APPOINTMENT.­ Commissioned officers of the Ready Reserve Corps shall be appointed by the President and commissioned officers of the Regular Corps shall be appointed by the President with the advice and consent of the Senate.

(4) ACTIVE DUTY.­ Commissioned officers of the Ready Reserve Corps shall at all times be subject to call to active duty by the Surgeon General, including active duty for the purpose of training.

(5) WARRANT OFFICERS.­ Warrant officers may be appointed to the Service for the purpose of providing support to the health and delivery systems maintained by the Service and any warrant officer appointed to the Service shall be considered for purposes of this Act and title 37, United States Code, to be a commissioned officer within the Commissioned Corps of the Service.

(b) ASSIMILATING RESERVE CORP OFFICERS INTO THE REGULAR CORPS. Effective on the date of enactment of the Affordable Health Choices Act, all individuals classified as officers in the Reserve Corps under this section (as such section existed on the day before the date of enactment of such Act) and serving on active duty shall be deemed to be commissioned officers of the Regular Corps.

(c) PURPOSE AND USE OF READY RESERVE.­

(1) PURPOSE.­ The purpose of the Ready Reserve Corps is to fulfill the need to have additional Commissioned Corps personnel available on short notice (similar to the uniformed service’s reserve program) to assist regular Commissioned Corps personnel to meet both routine public health and emergency response missions.

(2) USES.­The Ready Reserve Corps shall­

(A) participate in routine training to meet the general and specific needs of the Commissioned Corps;

(B) be available and ready for involuntary calls to active duty during national emergencies and public health crises, similar to the uniformed service reserve personnel;

(C) be available for backfilling critical positions left vacant during deployment of active duty Commissioned Corps members, as well as for deployment to respond to public health emergencies, both foreign and domestic; and

(D) be available for service assignment in isolated, hardship, and medically underserved communities (as defined in section 399SS) to improve access to health services.

(d) FUNDING.­ For the purpose of carrying out the duties and responsibilities of the Commissioned Corps under this section, there are authorized to be appropriated such sums as may be necessary to the Office of the Surgeon General for each of fiscal years 2010 through 2014. Funds appropriated under this subsection shall be used for recruitment and training of Commissioned Corps Officers.

He also ordered the police not to interfere with the SA and SS under any circumstances. This meant that anybody being harassed, beaten, or even murdered by Nazis, had nobody to turn to for help.

By a weird coincidence, there was also in Berlin a deranged Communist conducting a one-man uprising. An arsonist named Marinus van der Lubbe, 24, from Holland, had been wandering around Berlin for a week attempting to burn government buildings to protest capitalism and start a revolt. On February 27, he decided to burn the Reichstag building.

Carrying incendiary devices, he spent all day lurking around the building, before breaking in around 9 p.m. He took off his shirt, lit it on fire, then went to work using it as his torch.

The exact sequence of events will never be known, but Nazi storm troopers under the direction of Göring were also involved in torching the place. They had befriended the arsonist and may have known or even encouraged him to burn the Reichstag that night. The storm troopers, led by SA leader Karl Ernst, used the underground tunnel that connected Göring's residence with the cellar in the Reichstag. They entered the building, scattered gasoline and incendiaries, then hurried back through the tunnel.

The deep red glow of the burning Reichstag caught the eye of President Hindenburg and Vice-Chancellor Papen who were dining at a club facing the building. Papen put the elderly Hindenburg in his own car and took him to the scene.

Hitler was at Goebbels' apartment having dinner. They rushed to the scene where they met Göring who was already screaming false charges and making threats against the Communists.

At first glance, Hitler described the fire as a beacon from heaven.

After the elections of March 5, 1933, the Nazis began a systematic takeover of the state governments throughout Germany, ending a centuries old tradition of local political independence. Armed SA and SS thugs barged into local government offices using the state of emergency decree as a pretext to throw out legitimate office holders and replace them with Nazi Reich commissioners.

Political enemies were arrested by the thousands and put in hastily constructed holding pens. Old army barracks and abandoned factories were used as prisons. Once inside, prisoners were subjected to military style drills and harsh discipline. They were often beaten and sometimes even tortured to death. This was the very beginning of the Nazi concentration camp system.

At this time, these early concentration camps were loosely organized under the control of the SA and the rival SS. Many were little more than barbed wire stockades know as 'wild' concentration camps, set up by local Gauleiters and SA leaders.

For Adolf Hitler, the goal of a legally established dictatorship was now within reach. On March 15, 1933, a cabinet meeting was held during which Hitler and Göring discussed how to obstruct what was left of the democratic process to get an Enabling Act passed by the Reichstag. This law would hand over the constitutional functions of the Reichstag to Hitler, including the power to make laws, control the budget and approve treaties with foreign governments.

The emergency decree signed by Hindenburg on February 28, after the Reichstag fire, made it easy for them to interfere with non-Nazi elected representatives of the people by simply arresting them.

On March 21, in the Garrison Church at Potsdam, the burial place of Frederick the Great, an elaborate ceremony took place designed to ease public concern over Hitler and his gangster-like new regime.

Before the vote, Hitler made a speech in which he pledged to use restraint.

He got those votes from the Catholic Center Party after making a false promise to restore some basic rights already taken away by decree.

Obama is a thug who is destorying America any way he can

The White House’s announcement today that they will bypass the nomination process of the United States Senate to recess appoint Donald Berwick as head of the Centers for Medicare and Medicaid Services (CMS) is an act of unconscionable hubris.

The White House claims this act is in response to “Washington game-playing”, accusing Republicans of planning to “stall the nomination” as long as possible. This is nothing more than a baldfaced lie. Republicans cannot stall this nomination — it is impossible for them to do so under Senate rules — as not one hearing has been called or scheduled. Even the New York Times doesn’t buy the White House’s explanation, reporting: “The recess appointment was somewhat unusual because the Senate is in recess for less than two weeks and senators were still waiting for Dr. Berwick to submit responses to some of their requests for information.”

In truth, it is the White House that is playing games with the health policy of the nation and the welfare of the American people. In bypassing the traditional process through which the Senate advises and consents to nominees, President Obama is preventing Senators and the people they represent from obtaining any answers from Mr. Berwick, who has repeatedly made claims and statements that raise numerous questions about his suitability for this critical position.

Such questions would have concerned his remarks attacking private-sector solutions to health care problems, in support of “rationing with our eyes open,” and speaking of his affection for the United Kingdom’s National Health Service as “romantic.” In footage discovered and highlighted by the Heartland Institute in May, Mr. Berwick made this audacious statement: “Any health care funding plan that is just, equitable, civilized, and humane must, must redistribute wealth from the richer among us to the poorer and the less fortunate. Excellent health care is by definition redistributional.”

Senators have expressed concerns about statements like these, as well as Mr. Berwick’s background. He is a nominee with little management experience poised to head the second largest insurer on the planet, an agency with more funding to disperse than all but the top 15 economies in the world. In fact, the White House’s decision to make this recess appointment is as much a demonstration of their unwillingness to have any debate about Mr. Berwick’s views occur in the public eye as it is of their concern that some in their own party have privately questioned whether he is outside the mainstream.

Such questions are of course appropriate. Thanks to the White House’s decision, they will not be answered. Understand: Mr. Berwick’s position as head of CMS will give him unprecedented power to apply his views on health care policy under President Obama’s new health care regime. Yet thanks to the White House’s game playing, he will not answer one question, not one, before he is ensconced in a position where his radical policy views will ultimately effect the lives and health care of every American.

As we saw in the process of Obamacare’s passage, there is nothing – not precedent, not tradition, not even the most basic expectations of fairness or responsible governance – that will stop President Obama and his allies in their quest to remake American social policy in their image.

We need to ask why other politicians continue to give this president and his corrupt cabinet any respect.

When Rev. Jeremiah Wright first stepped onto the political scene, he opened the door to unabashed bigotry. For the very first time, most Americans were shocked to learn about Black Liberation theology. It had nothing to do with biblical Christianity whatsoever. It was about hatred of others who happened to be of European white descent. Liberation theology also has to do with being anti-Semitic.

Republicans will take the US house in Nov 2010.

Pelosi is out and a republican speaker is in.

The speaker is 3rd in line for the presidency.

When the republicans control the house there will be hearings about obama. Americans will know the truth about his birth origins etc.

The republican hearings will lead to obama's impeachment. BO will never resign.

Obama and biden will both be removed from office because of criminal fraud, extorsion, etc.

This leaves America with a republican president. The republican speaker of the house then becomes president until 2012.

Will obama flinch before the Nov 2010 elections or just before he will be required to offer proof of his citizenship after the elections and impeachment in the house etc?
